Terms of Service

Terms governing your use of the OnlineCareAI website, application, and related features.

Effective date: November 6, 2026

1. Agreement

These Terms & Conditions (“Terms”) govern your use of the OnlineCareAI website, application, and related features (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy and Medical & AI Disclaimer provide additional information about the Services.

2. Eligibility

The Services are intended for adults age 18 or older. By using the Services, you represent that you are at least 18 and legally able to accept these Terms. Do not create an account or use the Services if you are under 18.

3. Nature of Services

OnlineCareAI provides AI-generated health information, symptom education, wellness resources, mental well-being educational tools, and information about nonprescription medication products. OnlineCareAI is not a healthcare provider, medical practice, pharmacy, telehealth provider, or emergency response service. It does not provide medical diagnoses, prescriptions, individualized treatment, or professional medical advice. No physician–patient or other clinical relationship is created by use of the Services.

4. AI Limitations and Health Decisions

Artificial intelligence may generate information that is incorrect, incomplete, outdated, inconsistent, or unsuitable for your situation. Information depends in part on the details you provide and cannot replace a medical examination, diagnostic testing, or professional clinical judgment. Do not rely on the Services as the sole basis for health decisions or delay seeking qualified care because of an AI response. Screening questionnaires and symptom categories are educational indicators, not diagnoses or guarantees of safety.

5. Emergencies and Mental Health Crises

The Services are not intended for emergencies and are not continuously monitored by a healthcare professional. OnlineCareAI cannot contact emergency responders on your behalf or guarantee identification of an urgent condition. In the United States, call 911 for a medical emergency. If you are in emotional distress or a suicide-related crisis in the United States, call or text 988. Outside the United States, contact your local emergency or crisis service.

6. Account and Security

You are responsible for keeping your account credentials secure and for providing accurate information. Notify us promptly at support@onlinecare.com if you suspect unauthorized access. We may suspend access when reasonably necessary to protect the Services, users, or security.

7. Acceptable Use

You may not misuse the Services, interfere with their operation or security, impersonate another person, submit unlawful material, attempt unauthorized access, scrape or reverse engineer the platform except as permitted by law, or use AI-generated content to misrepresent that a licensed clinician has examined or treated someone.

8. User Content

You retain rights in content you submit. You grant OnlineCareAI a limited, nonexclusive license to receive, host, store, transmit, and process that content to provide, maintain, secure, and support the Services, consistent with the Privacy Policy. Do not submit information about another person unless you have the legal authority to do so.

9. Nonprescription Medication Information

Information about nonprescription medications is educational and is not a prescription or individualized recommendation. Product suitability may depend on age, pregnancy, medical conditions, allergies, interactions, and other factors. Read the full product label and consult a pharmacist or licensed clinician when appropriate. Purchases from outside retailers are governed by the retailer’s terms. OnlineCareAI does not itself prescribe, dispense, or ship medication.

10. Third-Party Services and Future Clinical Services

Some features may link to independent websites, pharmacies, retailers, or other service providers. Their products, availability, policies, and services are controlled by those third parties. OnlineCareAI does not currently provide clinician consultations or telehealth. Any future clinical access would be provided by independent third-party healthcare providers under separate terms and required consents.

11. Service Availability and Changes

We may modify, suspend, or discontinue features, subject to applicable law and any obligations relating to paid services. We do not guarantee uninterrupted availability or that every response will be accurate.

12. Intellectual Property

The Services, their design, software, and original content are owned by OnlineCareAI or its licensors and protected by applicable intellectual property laws. You receive a limited, revocable, nontransferable right to use the Services for personal, lawful purposes, subject to these Terms.

13. Disclaimer of Warranties

To the extent permitted by applicable law, the Services are provided on an “as available” and “as is” basis without warranties of uninterrupted operation, error-free performance, or fitness for a particular health purpose. Nothing in these Terms limits any warranty or consumer protection that cannot lawfully be excluded.

14. Limitation of Liability

To the extent permitted by applicable law, OnlineCareAI is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services. This provision does not exclude or limit liability where doing so would be prohibited by law, including for conduct or rights that cannot lawfully be waived.

15. Termination

You may stop using the Services at any time. We may restrict or terminate access for material violations of these Terms or to address security or safety concerns. Information handling after account closure is described in the Privacy Policy.

16. Applicable Law and Disputes

These Terms are governed by the laws of Michigan, United States, except where mandatory consumer protection laws require otherwise. Any dispute will be handled in a court of competent jurisdiction, subject to applicable law. Nothing in these Terms limits rights to seek relief from a regulator or other rights that cannot be waived.

17. Changes to Terms

We may update these Terms from time to time. We will post the revised version with its effective date and provide additional notice where required by law. Continued use after an update takes effect constitutes acceptance to the extent permitted by applicable law.
